CPS Sanctions Order for $12,000 - Vacated on 2/06/2024
Since filing his public announcement to run for County Attorney on January 12, 2024, my opponent has repeatedly attacked me for a District Court Sanctions Order entered in a CPS suit in September 2023, despite presumably knowing it was on appeal by CPS to the Dallas 5th Court of Appeals (5th COA). That appeal was dismissed on Tuesday February 6th when the 5th COA vacated the District Judge's Sanctions order against CPS. This ruling is appealable as well so nothing is final yet. The $12,000 fine is not enforceable and even if an appeal was to be granted and the sanction order eventually reinstated, Hunt County taxpayers would never be the source of payment since the District Court's order was issued against a state agency (DFPS). My opponent is either uninformed or dishonest when he continues to publicly state that Hunt County taxpayers would be responsible for this sanction. It is never good legal judgment to publicly comment on matters on appeal, especially to make that a major campaign issue.
Hunt County Declining Crime Rate
Since making his public announcement, my opponent has repeatedly attacked me for not prosecuting misdemeanor cases, despite not having a command of any statistics except selected data pulled from the public website www.txcourts.gov. More importantly, my opponent failed to provide any meaningful interpretation of the statistics nor provide comprehensive crime statistics for Hunt County. Attached are official Hunt County Jail Arrest records (without Personal Identifying Information) for 2011-2023 that clearly show a pattern - the total # of arrests from all local law enforcement agencies has declined significantly since 2011. I have only been in office since 2021 and am responsible solely for prosecuting misdemeanor cases that are submitted to my office. There are several possible explanations on why there have been less total arrests since 2011 in Hunt County (i.e. legislative changes in the Texas penal code, officer discretion, COVID-19, agencies not having sufficient patrol manpower, etc.). The other attachment is a summary spreadsheet using data extracted directly from the Hunt County Clerk judicial reporting system Odyssey - it shows the # of misdemeanor cases submitted to the Hunt County Attorney's Office for prosecution from 2011-2023. A closer comparison of the total # of misdemeanor cases submitted vs. total # of misdemeanor cases filed shows that there has been hardly any statistical variation from 2011-2023, despite my opponent's claim to the contrary.

From 2011 to 2023, there has been vary slight statistical deviation. In 2020, my predecessor kindly let me decide how to handle a significant # of misdemeanor cases submitted that year since I would have to prosecute in 2021. Thus 2021 saw more misdemeanor cases getting filed. In 2022, misdemeanor cases never submitted were received by my office and then rejected due to statute of limitations expiring (these crimes occurred prior to me taking office in 2021).
